The latest episode of School Leader Up Close, which is a companion video feature to School Leader magazine, features Kathryn Whalen, legal counsel/human resources at the New Jersey School Boards Association.

Whalen, formerly the director of the Office of School Ethics at the New Jersey Department of Education, shared insights from a “Legally Speaking” feature she wrote for the summer issue of School Leader, which highlights the impact of three recent Supreme Court decisions.

The cases demonstrate why it is imperative for all board of education members and boards of education to understand the specific facts and circumstances involved in these matters and, in consultation with board counsel, to decide the extent to which these cases will affect their conduct and decision-making moving forward.

Two of the cases were related in the sense that they both involved matters regarding the issue of “state action” and social media accounts.

The third case involved a labor and employment decision, which clarified the level or degree of harm that an employee must plead and prove to establish that an involuntary transfer was discriminatory, and violative of Title VII of the Civil Rights Act of 1964 (Title VII).
